Information on the processing of personal data by Profeina sp. z o.o.

1. What does this information concern?

This information concerns the rules for processing personal data by Profeina sp. z o.o. with its registered office in Warsaw, and in particular:
  • specifies the types of personal data we collect;
  • explains how and why we collect and use your personal data;
  • explains when and why we will share personal data with other entities; and
  • explains the rights and choices you have regarding your personal data.
We want it to be clear to you whether this Policy also covers the rules for processing your personal data. The information applies if:
  • you are a Client, i.e., you purchase services from us, or a Client Representative, i.e., you represent a Client in relations with us;
  • you are a Journalist or Editor, you cooperate with us in the preparation of content and/or its publication in the media;
  • you are a Business Partner, i.e., you provide us with products or services, or a Business Partner Representative, i.e., you represent a Partner in relations with us;
  • you are a Co-worker, i.e., you perform assignments for us related to the main area of our activity;
  • you are an Enterie Network Cooperator, i.e., you perform tasks commissioned by our Client in one of the markets where Enterie operates, or a Cooperator Representative representing a Cooperator in relations with us;
  • you are a User of our websites: www.profeina.pl and www.enterie.com, in particular you use the forms contained therein, the rules for processing your personal data can be found in our Privacy Policy at profeina.pl/pl/ochronadanych.
  • you are a Candidate, i.e., you are participating in a recruitment process;
We process your personal data in accordance with the General Data Protection Regulation of the European Union (2016/679) (“GDPR“) and other applicable data protection laws that supplement and/or implement the GDPR.

2. Who is the controller of your personal data?

The controller of your data is Profeina sp. z o.o. with its registered office in Warsaw, ul. Nieporęcka 2/1, 03-745 Warsaw (“Controller“, “we“, “us” or “our“). In matters related to the processing of personal data, you can contact us by correspondence or at the e-mail address: admin@profeina.pl.

3. What information about you do we collect?

If you are a Client or a Client Representative, we collect information provided to us in documents sent by you, during conversations, e-mail exchanges and meetings, including in particular information necessary to conclude and perform the contract. These may include, in particular: first name, last name, registered office address, mobile phone number, bank account number, Tax ID (NIP), National Business Registry Number (REGON), etc.If you are a Co-worker, we collect information provided to us in documents sent by you, during conversations, e-mail exchanges and meetings, including in particular information necessary to conclude and perform the contract. These may include, in particular: first name, last name, home address or registered office address, PESEL number, ID card number, bank account number, Tax ID (NIP), National Business Registry Number (REGON), etc.If you are a Partner or Cooperator, Partner Representative or Cooperator Representative, we collect contact information: first and last name, e-mail address, mobile or landline phone number, as well as information necessary to conclude and perform the contract: registered office address, bank account number, Tax ID (NIP), National Business Registry Number (REGON) and other data that we collect during the business relationship.If you are a Journalist or Editor, these are the first name, last name, position, name of the editorial office you work for, e-mail address, mobile or landline phone number and possibly other contact details used to maintain professional communication.If you are a User, we collect data necessary to establish a business relationship: first name, last name, e-mail address, website address, phone number, and data regarding the industry and area of activity – provided that you have shared this data with us through the form.If you are a Candidate, we collect information contained in application documents, provided to us during conversations, e-mail exchanges and meetings. These are, in particular, first name, last name, contact details, information about education, professional experience, qualifications, knowledge of foreign languages and interests.

4. For what purpose and on what basis do we process your data

If you are a Client, Journalist or Editor, Partner, Co-worker, Cooperator or User, we process your personal data:
  • for the purpose of concluding and performing a contract (Art. 6(1)(b) GDPR);
  • for the purpose of fulfilling legal obligations incumbent on the Controller (Art. 6(1)(c) GDPR);
  • for the purpose of pursuing the legitimate interest of the Data Controller (Art. 6(1)(f) GDPR), i.e., as part of activities performed in connection with the conclusion and performance of the contract, for purposes related to contract service, settlements, maintaining business relations, placing orders and commissions, claims, for administrative, statistical, reporting purposes, as well as direct marketing of our products and services.
If you are a Client Representative, Partner Representative or Cooperator Representative, we process your personal data:
  • for the purpose of fulfilling legal obligations incumbent on the Controller (Art. 6(1)(c) GDPR);
  • for the purpose of pursuing the legitimate interest of the Data Controller (Art. 6(1)(f) GDPR), i.e., in connection with the conclusion and performance of the contract with the entity you represent, for purposes related to contract service, settlements, maintaining business relations, placing orders and commissions, claims, for administrative, statistical, reporting purposes, as well as direct marketing of our products and services.
If you are a Candidate, we process your personal data:
  • with your consent (as long as it is a valid and effective basis for data processing) (Art. 6(1)(a) GDPR) for purposes related to the recruitment process;
  • for the purpose of concluding and performing an employment contract or a civil law contract (Art. 6(1)(b) GDPR);

5. To whom do we share your data

When it is necessary to achieve the purposes for which we process your data, we may transfer it to:
  • entities entitled to receive them on the basis of legal regulations (e.g., law enforcement agencies, supervisory authorities, etc.);
  • entities processing personal data on our behalf, i.e., companies providing specific services to us, the performance of which involves the processing of personal data, e.g., subcontractors, entities operating our IT systems or providing us with ICT tools, entities providing us with services in the field of accounting, advisory, consulting, marketing or recruitment;
  • entities co-creating the Enterie network in which we operate, providing specific services, the performance of which involves the processing of personal data, in particular providing the personal data of the person who contacted us to obtain an offer.

6. How long do we store your data

We store information about you for the period necessary to achieve the purposes presented in this privacy policy and in accordance with our data retention policies (unless a longer period is required by applicable law). Our data retention policies are based on applicable law. We will retain and use information about you to the extent necessary to comply with legal requirements (e.g., if we are required to retain information about you for tax purposes), resolve disputes, perform a contract, settlement, or for the purpose specified in this information.If you are a Client, Client Representative, Partner, Partner Representative, Co-worker, Cooperator, Cooperator Representative or User, we store your data as long as we are obliged to do so by law and for the period specified by the regulations regarding the statute of limitations for claims.If you are a Journalist or Editor, we store your data for as long as you work in the media industry and the editorial profile coincides with our clients’ portfolio, or until you withdraw your consent to their storage.If you are a Candidate, we store your data until the end of the recruitment process, and if you have consented to their processing in future recruitment processes, at most until you withdraw your consent.

7. What rights do you have

Exercising your rights regarding the processing of personal data, you may address the following requests to us:
  • if we process your personal data based on your consent, you can withdraw this consent at any time; however, remember that the withdrawal of consent does not affect the lawfulness of the processing we performed based on your consent before its withdrawal;
  • you can request access to your personal data and obtain a copy of it;
  • you can exercise the right to data portability, i.e., request from us to obtain your data in a structured, commonly used machine-readable format, and you can also request that we send this data directly to another controller if we process it in an automated manner based on your prior consent;
  • you can request the rectification of your personal data if it is incorrect or incomplete;
  • in connection with your particular situation, you can object to the processing of your personal data if we process it by invoking our legitimate interest; you can also object to the processing of your data for the purposes of direct communication conducted for our Clients or direct marketing;
  • in cases specified by law – e.g., if your data is out of date, unnecessary, processed illegally, and also if you have withdrawn your consent to its processing (when consent was the basis for such processing) or effectively objected to the processing of your personal data – you can request the erasure of your personal data;
  • you can also request the restriction of data processing for the time we consider your objection or notification regarding the correctness of your personal data, the lawfulness of processing your data or our legitimate interest, and also if you need the data to establish, exercise or defend claims.
In order to exercise the above rights, please contact us by correspondence or at the e-mail address admin@profeina.pl.In any case where you believe that our processing of personal data violates the provisions of the GDPR, you also have the right to lodge a complaint with the President of the Personal Data Protection Office (PUODO).

8. Do you have to provide us with your data and where do we get it from?

If you are a Client, Partner, Co-worker, Cooperator, providing your data is voluntary, but necessary to conclude and perform the contract and maintain business relations.If you are a Client Representative, Partner Representative, Cooperator Representative or User, providing your data is voluntary, but failure to do so will make it difficult or impossible for us to contact you or to conclude or perform the contract with the entity you represent. If you did not provide us with your data personally, it was provided to us by the entity you represent, or it comes from publicly available sources.If you are a Journalist or Editor, providing your data is voluntary, but necessary for us to provide you with information regarding our clients in the form of press releases, articles, statements, comments on current events, reports or invitations to meetings, interviews or conferences that may be helpful in your work.If you are a Candidate, providing your data is voluntary, however, without providing it, we will not be able to consider your candidacy in the recruitment processes. In any case, we have the right to request from you the data specified in Art. 221 of the Labor Code.
