  • You are Business partner, i.e. you provide us with products or services, or Representative of the Business Partner, i.e. you represent the Partner in relations with us;
  • You are Collaborator, i.e. you carry out orders for us related to our main area of ​​activity;
  • You are A partner of the Enterie chain, i.e. you carry out tasks commissioned by our client on one of the markets where Enterie operates, or Representative of the Cooperator you represent the Collaborator in relations with us;
  • You are User our websites: www.profeina.pl and www.enterie.com, in particular you use the forms contained there, the rules for the processing of your personal data can be found in our Privacy Policy on the website profeina.pl/pl/ochronadani.
  • You are Candidate, i.e. you are taking part in recruitment;

We process your personal data in accordance with the European Union General Data Protection Regulation (2016/679) (“GDPR") and other applicable provisions on the protection of personal data that supplement and/or implement the GDPR.

3. What information do we collect about you?

If you are Customer or Customer Representative, we collect information provided to us in the documents you send, during conversations, e-mail exchanges and meetings, including in particular information necessary to conclude and perform the contract. These may include in particular: name, surname, registered office address, mobile phone number, bank account number, NIP, REGON and others.

If you are Collaborator, we collect information provided to us in the documents you send, during conversations, e-mail exchanges and meetings, including in particular information necessary to conclude and perform the contract. These may include in particular: name, surname, residential or registered office address, PESEL number, ID card number, bank account number, NIP, REGON and others.

If you are Partner or cooperator, Partner's representative or Representative of the Cooperator we collect contact information: name and surname, e-mail address, mobile or landline telephone number, as well as information necessary to conclude and perform the contract: registered office address, bank account number, NIP, REGON and other data that we collect during the business relationship.

If you are A journalist or Editor these are name, surname, position, name of the editorial office for which you work, e-mail address, mobile or landline telephone number and possibly other contact details that are used to maintain professional communication.

If you are User we collect data necessary to establish a business relationship: name, surname, e-mail address, website address, telephone number, and data regarding the industry and area of ​​activity - if you have provided this data to us via the form.

If you are Candidate, we collect information contained in application documents, provided to us during conversations, e-mail exchanges and meetings. These include, in particular, name, surname, contact details, information about education, professional experience, qualifications, knowledge of foreign languages ​​and interests.

4. For what purpose and on what basis do we process your data

If you are Customer, A journalist or Editor, Partner, Collaborator, A cooperator or User we process your personal data:

  • in order to conclude and perform the contract (Article 6(1)(b) of the GDPR);
  • in order to fulfill the legal obligations imposed on the Administrator (Article 6(1)(c) of the GDPR);
  • in order to pursue the legitimate interest of the Data Administrator (Article 6(1)(f) of the GDPR), i.e. as part of activities performed in connection with the conclusion and performance of the contract, for purposes related to contract management, settlements, maintaining business relations, placing orders and orders, claims, for administrative, statistical and reporting purposes, as well as direct marketing of our products and services.

If you are Customer Representative, Partner's representative or Representative of the Cooperator we process your personal data:

  • in order to fulfill the legal obligations imposed on the Administrator (Article 6(1)(c) of the GDPR);
  • in order to implement the legitimate interest of the Data Administrator (Article 6(1)(f) of the GDPR), i.e. in connection with the conclusion and performance of a contract with the entity you represent, for purposes related to contract processing, settlements, maintaining business relations, placing orders and orders, claims, for administrative, statistical and reporting purposes, as well as direct marketing of our products and services.

If you are Candidate, we process your personal data:

  • with your consent (provided that it is a valid and effective basis for data processing) (Article 6(1)(a) of the GDPR) for purposes related to recruitment;
  • in order to conclude and perform an employment contract or a civil law contract (Article 6(1)(b) of the GDPR);

5. Who do we share your data with?

When it is necessary to achieve the purposes for which we process your data, we may transfer it:

  • entities authorized to receive them under the law (e.g. law enforcement agencies, supervisory authorities, etc.);
  • entities processing personal data on our behalf, i.e. companies providing us with specific services that involve the processing of personal data. e.g. subcontractors, entities operating our IT systems or providing us with ICT tools, entities providing us with accounting, advisory, consulting, marketing or recruitment services;
  • entities co-creating the Enterie network in which we operate, providing specific services that involve the processing of personal data, in particular providing personal data of the person who contacted us in order to obtain an offer.

6. How long we store your data

We retain information about you for the period necessary to achieve the purposes outlined in this privacy policy and consistent with our data retention policies (unless a longer period is required by applicable law). Our data storage policies are based on applicable law. We will retain and use information about you to the extent necessary to comply with legal requirements (e.g. if we are obliged to retain information about you for tax purposes), resolve disputes, execute a contract, settlement or for the purposes specified in this information.

If you are Customer, Customer Representative, Partner, Partner's representative Collaborator, Collaborator, Representative of the Collaborator or User we store your data for as long as we are obliged to do so by law and for the period specified by the provisions regarding the limitation of claims.

If you are A journalist or Editor we store your data for as long as you work in the media industry and the editorial profile is consistent with our clients' portfolio or until you withdraw your consent to its storage.

If you are Candidate, we store your data until the recruitment process is completed, and if you have consented to their processing in future recruitment processes, at the latest until you withdraw your consent.

7. What rights do you have?

By exercising your rights regarding the processing of personal data, you can submit the following requests to us:

  • if we process your personal data on the basis of your consent, you can withdraw this consent at any time; remember, however, that withdrawal of consent does not affect the lawfulness of the processing we carried out on the basis of your consent before its withdrawal;
  • you can request access to your personal data and obtain a copy of it;
  • you can exercise the right to transfer your personal data, i.e. request that we obtain your data in a structured, commonly used, machine-readable format, and you can also request that we send this data directly to another administrator if we process it in an automated manner based on your prior consent;
  • you can request that your personal data be corrected if it is incorrect or incomplete;
  • due to your particular situation, you may object to the processing of your personal data if we process it based on our legitimate interest; you can also object to the processing of your data for the purposes of direct communication for our clients or direct marketing;
  • in cases specified by law - e.g. if your data is outdated, unnecessary, processed illegally, and if you have withdrawn your consent to their processing (when consent was the basis for such processing) or you have successfully objected to the processing of your personal data - you may request the deletion of your personal data;
  • you can also request the restriction of data processing while we consider your objection or notification regarding the correctness of your personal data, the lawfulness of the processing of your data or our legitimate interest, as well as if you need the data to establish, pursue or defend claims.

In any case in which you believe that our processing of personal data violates the provisions of the GDPR, you also have the right to lodge a complaint with the President of the Personal Data Protection Office.

8. Do you have to provide us with your data and where do we get it from?

If you are Customer, Partner, Collaborator, A cooperator Providing your data is voluntary, but necessary to conclude and perform the contract and maintain business relations.

If you are Customer Representative, Partner's representative, Representative of the Cooperator or User Providing your data is voluntary, but failure to provide them will make it difficult or impossible for us to contact or conclude or perform a contract with the entity you represent. If you did not provide us with your data personally, it was provided to us by the entity you represent or it comes from publicly available sources.

If you are A journalist or Editor Providing your data is voluntary, but necessary so that we can provide you with information about our clients in the form of press releases, articles, statements, comments on current events, reports or invitations to meetings, interviews or conferences that may be helpful in your work.

If you are Candidate, providing your data is voluntary, but without providing it, we will not be able to consider your candidacy in the recruitment process. In any case, we have the right to request from you the data specified in Art. 221 of the Labor Code.
